NWLC Submits Comment Opposing DOJ Proposed Rule to Shield its Attorneys from Misconduct Investigations
On April 6, 2026, the National Women’s Law Center submitted a comment in opposition to the Department of Justice’s proposed rule entitled “Review of State Bar Complaints and Allegations Against Department of Justice Employees.” This proposed rule would allow only DOJ to investigate ethics allegations against DOJ attorneys, without any deadline or transparency requirements, while deterring investigation by state bar disciplinary authorities. In effect, the rule would shield DOJ attorneys from consequences for misconduct unless the agency decides to take action. This proposed rule is especially concerning because DOJ has faced increasing criticism for conducting politicized prosecutions, deceptive and dilatory courtroom tactics, and failure to comply with court orders.
