On February 25, 2025, the National Women’s Law Center, alongside 47 other national and state health care advocacy organizations, joined an amicus brief to the U.S. Supreme Court in Braidwood Management, Inc. v. Kennedy. Our brief supports the federal government in its defense of the expert agency, U.S. Preventive Services Task Force (USPSTF), that recommends most of the 100 preventive health services that the Affordable Care Act (ACA) requires insurers to cover without cost-sharing. The U.S. Court of Appeals for the Fifth Circuit held that USPSTF violated the Appointments Clause of the U.S. Constitution because its members are not confirmed by Congress but their recommendations have the force of law. Our brief explains that if the Court of Appeals’ decision is allowed to stand—and if the case is ultimately resolved in the way the District Court determined it should be: rescinding the requirement that services recommended by USPSTF post-2010 be covered with no cost-sharing—our nation’s health will be put at risk. We know that when costs for preventive services are high, patients, particularly those who are the most marginalized, forgo care. This is why Congress enacted the ACA, and we urge the Supreme Court to again uphold this important health care coverage law against attacks from conservative legal extremists.
