US v. McIver

On April 6, 2026, the National Women’s Law Center joined the ACLU of New Jersey and the NAACP Legal Defense Fund in filing an amicus brief in the U.S. Court of Appeals for the Third Circuit in support of U.S. Representative LaMonica McIver. Congresswoman McIver is facing federal charges related to her congressional oversight visit of Delaney Hall, an immigration detention center in Newark, New Jersey. The brief argues that these charges should be dismissed because Rep. McIver has legislative immunity to prosecution while performing her duties as a Congresswoman based on the Speech and Debate Clause of the U.S. Constitution. Further, we argue that the court must consider the important separation of powers concerns at stake in this clearly retributive political prosecution.
