Federal law and many state laws protect LGBTQIA+ people from discrimination at work, in school, and in health care. For decades, many LGBTQIA+ people facing discrimination have generally turned to federal agencies to investigate their claims—such as the U.S. Equal Employment Opportunity Commission (EEOC) or the U.S. Department of Education’s Office for Civil Rights.

In this current climate, as the federal government withdraws from robust enforcement of civil rights statutes for LGBTQIA+ people, state agencies can and should play a larger role in ensuring accountability and safeguarding the rights of LGBTQIA+ people. Stretching back to the 1980s, states have passed proactive laws that explicitly protect against discrimination based on sexual orientation and gender identity.
