NWLC Responds to the Department of Education’s Announcement that Discrimination Against LGBTQ Students is Prohibited Under Title IX

(Washington, D.C.) Today, the Department of Education announced that it will enforce Title IX’s prohibition on sex discrimination to include discrimination based on sexual orientation and gender identity, consistent with the reasoning in Bostock v. Clayton County.

“Students deserve the same rights and protections, regardless of their sexual orientation and gender identity, and we’re glad the Department of Education made that clear. With the rise in harmful anti-trans legislation by state lawmakers and ongoing harassment and violence against LGBTQ students, it’s critical the Department is explicit on protecting LGBTQ students and affirming Title IX’s coverage.”
