On August 30, 2024, the National Women’s Law Center joined an amicus brief before the Supreme Court in U.S. v. Skrmetti, a case challenging Tennessee’s ban on gender-affirming care for transgender youth. NWLC joined over a dozen legal scholars to affirm that this ban discriminates on the basis of sex and so is subject to heightened scrutiny.

Our brief asks the Supreme Court to overturn the Sixth Circuit’s decision, which refused to apply heightened scrutiny to this ban. We explain that Sixth Circuit’s reasoning would create broad new exceptions that run afoul of the Supreme Court’s rulings on sex discrimination over the past half century, threatening antidiscrimination protections for everyone.
