On November 19, 2025, NWLC joined A Better Balance and ten other workers’ rights organizations in filing an amicus brief in the Second Circuit Court of Appeals in Won v. Amazon.com Services, LLC. The brief argues that the Second Circuit should reverse the district court’s ruling that Amazon did not violate the New York City Human Rights Law (NYCHRL) in failing to provide the plaintiff, Caonaissa Won, her requested schedule modification for her caregiving responsibilities. 

As the brief describes, the New York City Council amended the NYCHRL in 2015 to include caregivers as a protected class specifically to address caregiver discrimination in the workplace. The brief explains that the NYCHRL’s legislative history makes clear the law’s intent to ensure caregivers receive equal treatment at work, and that case law mandates summary judgment only be granted in the true absence of evidence of discrimination. Here, the correct application of the NYCHRL would require Amazon to grant Ms. Won the same schedule flexibility she requested for caregiving reasons that the company provides other employees for non-caregiving reasons, such as pursuing their own education. The brief argues the Court should vacate the district court’s decision granting summary judgment to Amazon on Ms. Won’s NYCHRL caregiver status discrimination claim.
