Simms et al. v. GSRH Wings PA and Rosa v. Five Below
On June 25, NWLC and the Public Interest Law Center of PA, along with UNITE HERE Local 274, Philadelphia Council AFL-CIO, and Community Legal Services of Philadelphia, filed amicus briefs in two identical cases in Pennsylvania Commonwealth Court, Simms et al. v. GSRH Wings PA, LLC and Rosa v. Five Below, Inc. These cases involve two employers challenging the Philadelphia Fair Workweek Law, claiming it violates the City’s Home Rule Authority and imposes excessive fines in violation of the PA Constitution. Our amicus brief details the harm of unstable work schedules to workers, families, and employers, and uplifts the robust body of social science research on the positive impacts of laws providing fair, stable, and predictable work schedules.
