Pennsylvania v. Trump
On March 4, NWLC and our partners at Americans United for Separation of Church and State, along with 63 other civil rights and gender justice organizations, filed an amicus brief before the U.S. Court of Appeals for the Third Circuit in Pennsylvania v. Trump. The lawsuit, filed by Pennsylvania and New Jersey, challenges the religious and moral exemptions from the ACA’s contraceptive coverage requirement that were promulgated during the first Trump administration. Our brief explains that the Religious Freedom Restoration Act neither authorizes nor requires the sweeping exemptions, and that the exemptions are arbitrary and capricious because they are overbroad and because the agencies ignored the substantial evidence before them detailing the harm the rules will cause to the health and equality of women and others who can become pregnant.
