NWLC Submit Public Comment Opposing Proposal to Restrict Immigrant Access to Refundable Tax Credits

The National Women’s Law Center submitted a public comment opposing the Department of Treasury’s proposed rule that would restrict eligibility for refundable portions of certain federal income tax credits—the Earned Income Tax Credit (EITC), the Child Tax Credit (CTC), the American Opportunity Tax Credit (AOTC), and the Adoption Tax Credit—by classifying them as “Federal public benefits” under Personal Responsibility and Work Opportunity Reconciliation Act. Those affected would include immigrants with Temporary Protected Status, asylum applicants, victims of serious crimes holding U visas, and recipients of Deferred Action for Childhood Arrivals (DACA). The proposed rule would arbitrarily deny thousands of immigrant families access to valuable refundable tax credits, especially harm the economic security of immigrant women and their families, and deeply affect the industries in which immigrant women workers predominate.
