NWLC Makes Second Move to Protect Student Survivors and Title IX Rule Safeguards

FORT WORTH, Texas (April 1) — On Monday, the National Women’s Law Center (NWLC) filed a motion to intervene in a federal lawsuit to block enforcement of the Trump administration’s harmful 2020 Title IX rule regarding sexual harassment on school campuses. The motion, which also seeks to reinstate protections under the Biden administration’s 2024 Title IX rule, comes after NWLC sought intervention in a separate lawsuit in Kentucky last month

NWLC files this motion with co-counsel Mehri & Skalet and Carter Law Group on behalf of the Victim Rights Law Center (VRLC) and “Jane Doe.”

“The Trump administration has so far done nothing to prioritize student safety and inclusion, and has instead taken actions to jeopardize educational opportunities for student survivors across the country. The district court’s cruel and flawed decision contributes to a significant weakening of protections for student survivors of sex-based harassment and assault — protections that we are seeking to restore by intervening to appeal the court’s decision,” said Shiwali Patel, senior director of safe and inclusive schools at the National Women’s Law Center. “We are proud to continue representing and fighting alongside the Victim Rights Law Center and our client, Jane Doe to restore protections for all students, including protections against hostile questioning and abusive tactics in school investigations of sexual assault complaints.”

“Student survivors like myself should have the right to not be retraumatized through hostile cross-examination by their rapist’s or abuser’s advisor,” said NWLC client and student survivor Jane Doe. “I am proud to fight for student survivors everywhere and be represented in this intervention.”
