In 1971, a year before the ERA was sent to the states for ratification, the Supreme Court “applied the Equal Protection Clause of the 14th Amendment to strike down a law that discriminated against women,” according to the National Women’s Law Center. Since then, the 14th Amendment, along with Title VII of the Civil Rights Act, which prevents sex discrimination in employment, have been used as the basis for women’s rights in the United States.
