“They’re just wrong,” National Women’s Law Center Senior Director Shiwali Patel said in a phone interview. “Courts have recognized over and over again, citing to the Supreme Court, that Title IX is broad in its scope, and so it can’t be used to justify exclusion of a vulnerable group of students from educational opportunities just because of how they look or who they are — including students who are trans.”
