National Women’s Law Center and the undersigned organizations committed to workplace equality have joined to express their support for the Proposed Enforcement Guidance and believe it will promote the reduction of sex-based discrimination and retaliation in the workforce. The EEOC last issued policy guidance on retaliation in 1998; since then, the law has evolved significantly and retaliation has become the most frequently alleged basis of discrimination in EEOC claims. We write to offer suggestions for further clarifying and strengthening the Proposed Enforcement Guidance.
