On December 23, 2020, the National Women’s Law Center, led by The Leadership Conference on Civil and Human Rights and The Leadership Conference Education Fund and joined by 15 other organizations, submitted an amicus brief to the United States Supreme Court. The brief was filed in Federal Communications Commission v. Prometheus Radio Project, which asks the Supreme Court to decide whether the FCC should be required to adhere to its longstanding claimed policy objective of fostering gender and racial diversity in broadcast media ownership. The amicus brief encourages the Court to affirm the lower court’s decision that the FCC failed to conduct even a minimally adequate analysis of how its rule on media consolidation would harm women and people of color, amounting to “arbitrary and capricious” actions in violation of the law. In short, this case will determine whether the FCC must support its conclusions with actual evidence and data, while being transparent and accountable about those findings. The case is scheduled for argument on January 19, 2021.
