The Nebraska Legislature is considering LB 730, a facilities ban that would bar transgender students from accessing restrooms and locker rooms in public schools, public post-secondary institutions, and state agency buildings. The National Women’s Law Center Action Fund submitted written testimony in opposition to LB 730, which outlined how exclusionary facilities bans exacerbate policing of students’ gender and inappropriate scrutiny of children’s bodies. NWLCAF’s testimony outlines the repeated instances of harassment related to gender policing in restrooms, the harms that such harassment poses for both cisgender and transgender students, and the legal liability assumed by schools when exclusionary policies are adopted.
